Terms of Service for Cyber Creative Digital Solutions

1. Agreement to Terms
By using our website or purchasing our services (“Web Development, Graphic Design, Email Hosting, Web Hosting, Domain Registration, Technical Support”), you agree to be bound by these Terms of Service.

2. Description of Services
We agree to provide digital services as outlined in the specific project proposal or invoice. Services include but are not limited to:

  • Custom website design and development.

  • Graphic design (logos, social media graphics, print).

  • Reselling of web hosting and email hosting services.

  • Domain name registration (.com, .co.zw).

  • Technical support and maintenance.

3. Client Responsibilities
The Client agrees to:

  • Provide all necessary content (text, images, logos) in a timely manner.

  • Communicate clearly and respond to requests for feedback.

  • Obtain necessary permissions for any third-party materials (e.g., stock photos, fonts) provided to us.

  • Adhere to the Acceptable Use Policy (Section 7).

4. Third-Party Hosting & Domain Registration (Liability Disclaimer)

  • Acknowledgment: The Client acknowledges that Cyber Creative Digital Solutions is a reseller of hosting and domain registration services provided by third-party companies.

  • No Liability for Outages: While we choose reputable partners, we do not control the underlying physical servers or global internet infrastructure. Therefore, we are not liable for occasional service interruptions, downtime, or data loss caused by third-party hosting providers, force majeure, or internet outages .

  • Domain Ownership: The Client owns their domain name. We will register it under the Client’s name and email address. The Client is responsible for renewing the domain annually. We are not liable if a domain expires due to the Client’s failure to pay renewal fees on time.

5. Payment Terms

  • Quotes: All quotes are valid for 30 days.

  • Deposits: A 30% deposit is required to begin work on custom websites or design projects. The remaining 70% is due upon completion before the final files or website are launched.

  • Late Payment: Late payments may result in suspension of hosting services or delays in project delivery.

6. Intellectual Property

  • Our Work: Upon full payment, we transfer the copyright of the custom website design and code to the Client. We retain the right to display the finished work in our portfolio.

  • Third-Party Software: Any premium plugins, themes, or fonts purchased by the Client on their behalf remain licensed to the Client.

  • Your Content: You retain ownership of all text, images, and data you provide to us.

7. Acceptable Use Policy (Legal Compliance)
The Client agrees not to use our services (website hosting, email, or development) for any illegal activities under Zimbabwean law, including but not limited to:

  • Hosting or distributing child sexual abuse material (CSAM).

  • Sending spam or bulk unsolicited emails.

  • Hosting content that incites violence or hatred.

  • Infringing on intellectual property rights.

Hosting Provider Liability Shield: Under Section 379C of Zimbabwe’s Cyber and Data Protection Act, if we receive a valid court order to remove specific illegal content from your website, we are required to comply immediately. We will not be liable for removing such content, nor will it constitute a breach of our contract .

8. Limitation of Liability
To the maximum extent permitted by law, Cyber Creative Digital Solutions shall not be liable for any indirect, incidental, or consequential damages (including lost profits or data) arising from the use or inability to use our services, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount paid by the Client for the specific service in question.

9. Termination

  • By Client: You may cancel monthly hosting services with 30 days’ notice.

  • By Us: We reserve the right to suspend or terminate services immediately if the Client breaches the Acceptable Use Policy or fails to pay overdue invoices.

10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Zimbabwe. Any disputes shall be subject to the exclusive jurisdiction of the courts of Zimbabwe.
